TERMS OF SERVICE

1. Acceptance of Terms

By accessing and using Harmony ("the Platform"), you accept and agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use the Platform.

2. Description of Service

Harmony is a patronage platform that facilitates monthly recurring financial support from users ("Angels") to musical artists ("Artists"). The Platform enables direct financial relationships between Angels and Artists, with Artists offering exclusive content and experiences ("Tributes") to their supporters.

3. User Accounts

3.1 Account Creation

To use certain features of the Platform, you must create an account. You agree to provide accurate, current, and complete information during registration and to update such information to keep it accurate, current, and complete.

3.2 Account Security

You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account.

3.3 Account Types

• Angel Accounts: For users who wish to support artists through monthly subscriptions
• Artist Accounts: For musicians who wish to receive support and offer tributes to their Angels

4. Subscriptions and Payments

4.1 Subscription Terms

When you become an Angel for an artist, you authorize Harmony to charge your payment method on a recurring monthly basis for the amount you selected (minimum £5 GBP). Subscriptions automatically renew unless cancelled.

4.2 Payment Processing

All payments are processed through Stripe, our third-party payment processor. By providing payment information, you represent that you are authorized to use the payment method and authorize us to charge it.

4.3 Platform Fee

Harmony charges a 5% platform fee (minimum £1 GBP) on all contributions. The remaining 95% goes directly to the artist you are supporting.

4.4 Refund Policy

All contributions are final and non-refundable, except in cases of billing errors or fraud. If you believe you were charged in error, contact us within 30 days at contact@harmonyand.me.

4.5 Cancellation

You may cancel your subscription at any time through your account dashboard. Cancellation takes effect at the end of your current billing period. You will not receive a refund for the current period.

4.6 Price Changes

You may modify your monthly contribution amount at any time. Changes take effect in the next billing cycle. Artists cannot change the price of your existing subscription without your explicit consent.

5. Artist Obligations

5.1 Content and Tributes

Artists are solely responsible for all content they post and tributes they offer. Artists must fulfill all promised tributes to their Angels in a timely manner.

5.2 Payouts

Artists will receive monthly payouts of their accumulated earnings minus the platform fee. Payouts are processed within 7 business days after month-end, subject to Stripe's payout schedule.

5.3 Artist Eligibility

Artists must be at least 18 years old, legally able to enter into contracts, and comply with all applicable laws regarding income reporting and taxation.

5.4 Tax Obligations

Artists are responsible for reporting their income and paying all applicable taxes. Harmony will provide necessary tax documentation as required by law.

6. Content Guidelines

6.1 Prohibited Content

Users may not post content that is illegal, harmful, threatening, abusive, harassing, defamatory, vulgar, obscene, or otherwise objectionable. We reserve the right to remove any content that violates these terms.

6.2 Intellectual Property

Artists retain all rights to their original content. By posting content on Harmony, artists grant us a limited license to display, distribute, and promote such content solely for the purpose of operating the Platform.

6.3 Copyright Infringement

We respect intellectual property rights. If you believe your work has been copied in a way that constitutes copyright infringement, please contact us at contact@harmonyand.me with details.

7. User Conduct

You agree not to:

• Use the Platform for any illegal purpose or in violation of any applicable laws
• Impersonate any person or entity or falsely state your affiliation with any person or entity
• Interfere with or disrupt the Platform or servers connected to the Platform
• Attempt to gain unauthorized access to any portion of the Platform
• Use automated systems (bots, scrapers) to access the Platform
• Harass, abuse, or harm other users

8. Tributes and Rewards

8.1 Artist Responsibility

Artists are solely responsible for creating and delivering tributes to their Angels. Harmony is not responsible for the quality, legality, or delivery of tributes.

8.2 Disputes

Any disputes between Angels and Artists regarding tributes should be resolved directly between the parties. Harmony may, at its discretion, assist in resolving disputes but is not obligated to do so.

8.3 Physical Goods

For physical tributes, artists are responsible for shipping costs and delivery. Angels must provide accurate shipping information.

9. Badge Numbers

Badge numbers are assigned sequentially to Angels for each artist they support, indicating their position as an early supporter. Badge numbers are permanent and non-transferable.

10. Termination

10.1 By Users

You may terminate your account at any time by contacting us. Upon termination, all subscriptions will be cancelled and you will lose access to exclusive content.

10.2 By Harmony

We reserve the right to suspend or terminate accounts that violate these Terms of Service, engage in fraudulent activity, or for any reason at our sole discretion.

11. Disclaimers

THE PLATFORM IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. WE DO NOT WARRANT THAT THE PLATFORM WILL BE UNINTERRUPTED OR ERROR-FREE.

12. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, HARMONY SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES.

13. Indemnification

You agree to indemnify and hold Harmony harmless from any claims, damages, losses, liabilities, and expenses arising from your use of the Platform or violation of these Terms.

14. Dispute Resolution

14.1 Governing Law

These Terms shall be governed by the laws of the United Kingdom.

14.2 Arbitration

Any disputes arising from these Terms or use of the Platform shall be resolved through binding arbitration in accordance with UK law, except where prohibited.

15. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify users of material changes via email or prominent notice on the Platform. Continued use after changes constitutes acceptance of the new Terms.
